INITIAL WELLNESS GUARANTEE: The Breeder found the dog to be in good health and temperament as of the date of this Agreement. Unless otherwise agreed, the dog must be examined by a licensed veterinarian for a wellness exam within seventy-two (72) hours (three (3) business days) of Buyer taking possession of the dog. The Breeder has carefully administered the dog's vaccinations as recorded in the vaccination record according to the manufacturer's recommended schedule for each vaccine. If the dog is not examined by a licensed veterinarian within this time frame, this Initial Wellness Guarantee is void.
- Please ensure that the puppy is kept in a kennel or held in the waiting room of a veterinary office and that the exam room is properly disinfected before the appointment.
- Do not let the puppy walk on the floor in the veterinary office and ensure the room is cleaned prior to putting your puppy on the table. I recommend bringing a clean towel or blanket with you to be safe.
THE BREEDER SHALL NOT BE RESPONSIBLE FOR ANY MEDICAL EXPENSES INCURRED.
1. INITIAL INCLUSIONS:
- If the examining veterinarian discovers anything life-threatening, a written diagnosis from the examining veterinarian must be submitted to the Breeder within 24 hours after said diagnosis. During the initial exam by a licensed veterinarian of Purchaser's choice, if puppy is found to be in poor health or any physical health issue is detected that would require further veterinarian care other than required immunizations and/or treatment for any type of parasite or bacteria whether internal or external, you MUST contact us IMMEDIATELY and puppy MUST be returned to BelovedDoodles within 3 days. You must also bring a signed statement from the veterinarian showing the date of the exam (within 72 hours of release) on which veterinarian conducted the examination and the reason why the puppy is in poor health. This statement must include a description of the symptoms and probable diagnosis. Since it is your intention to return the puppy for a refund, your veterinarian should NOT provide any further immunisations or treatment for the puppy. BelovedDoodles is not responsible for the veterinary bills associated with the initial visit. If you choose to keep the puppy, Beloved Doodles is released from ALL liability and ALL medical bills, including the initial bill that results from the findings. No further health guarantee will be included for the puppy.
ONE YEAR HEALTH GUARANTEE: Even though the Breeder has worked diligently to carefully monitor the dog's development and has performed health testing in an effort to reduce the risk of disease and any condition that could potentially negatively impact health and quality of life of the dog, the Buyer understands that dogs are living beings and that these factors alone do not guarantee that the dog will never have any illness or any health condition.
- Eye Defects. Genetic defects of the eye causing progressive blindness and/or requiring surgery to prevent blindness, as diagnosed by a board-certified veterinary ophthalmologist.
- Cardiac and Liver Disorders. Cardiac disorders of clear genetic origin that require surgery or that, after treatment, are life-threatening or diminish the dog's quality of life. Screening exams as part of a wellness exam or for the purpose of OFA certification are both considered screening exams and will require further testing for a diagnosis by a board-certified canine cardiologist or licensed veterinarian specialist.
- Hip Dysplasia. Hip dysplasia is multigenic and multifactorial. Moreover, dogs can have signs of osteoarthritis or hip dysplasia on an X-ray, but those dogs may never have clinical signs of either condition even if they are produced by parents with no radiological or clinical signs. This guarantee only covers severe clinical hip dysplasia within the stated period providing the dog has not been overweight, exposed to unhealthy environmental conditions, trauma, or had any physical injury or issues which cause is unknown or may have an environmental link. Since current veterinary science shows that dysplasia/osteoarthritis is more a product of nutrition and environment than genetics, dogs that are at any point overweight or that incur injury to bones or joints from over-exercise or exposure to improper or harsh environment are explicitly excluded from guarantee of hip or elbow dysplasia. All health guarantee requests, and submission of documentation shall be submitted to the Breeder by the Buyer within seven (7) days of diagnosis. At a minimum, radiographic evidence of hip-dysplasia-associated osteoarthritis must be provided to be considered severe dysplasia along with evidence of severe clinical symptoms, with a second opinion provided at the Buyer's expense by a Breeder-approved veterinarian or certification authority (i.e., OFA or PennHIP). The Buyer must show proof of healthy weight by having their veterinarian evaluate the dog's body condition score at all veterinary visits.
- Death. If the dog dies, and the Buyer suspects a genetic or other condition guaranteed within this Agreement, the Buyer must have a necropsy performed by a licensed veterinarian at the Buyer's expense. The Buyer must include copies of diagnosis and all treatment documentation to the Breeder. The Breeder reserves the right to request a second opinion from a veterinarian of their choice in the local area of the Buyer or via phone consult with a veterinarian in any location and grants permission to the Breeder and the Breeder's veterinarian to consult with all professionals treating the dog.
- REMEDY: Should a guaranteed inclusion occur within this guarantee period and all requirements have been satisfied as of the terms of this Agreement, then the dog must be spayed or neutered. Evidence of the spay/neuter is to be provided to the Breeder in writing within seven (7) days after the procedure and must be on veterinary letterhead, showing the dog's name, date of birth, and microchip number (if applicable). Upon completion of these requirements, the Buyer may choose one of the following options: 1. Keep the dog and receive a dog valued up to the adoption fee of this dog from the Breeder. There shall be no refunds or adjustments allowed by the Breeder for any adoption fee difference. Rehome the dog to an alternative good, suitable home. The Buyer will then have the option to either receive a dog valued up to the adoption fee of this dog from the Breeder or not. There shall be no refunds or adjustments allowed by the Breeder for any adoption fee difference.
2. GUARANTEE EXCLUSIONS:
- Characteristics. Because there are many factors that impact a dog's development (i.e. nutrition, environment, activity levels, trauma, etc.) the Breeder excludes characteristics such as, but not limited to: size, color, conformation, temperament, etc.
- Nutrition. The Breeder provides nutrition resources before and during adoption and recommends the Royal Canine brand of dog food
- Surgical Procedures. The Breeder excludes all surgical procedure costs including injury or death from any procedure.
- Trauma & Environment. The Breeder excludes all associated health issues associated with trauma, environment, over-exercising, or failure to maintain general health care of the dog, including allowing the dog to become overweight (overweight is defined as body condition score over 5 on a scale of 9).
PREVENTATIVE HEALTH: The Buyer agrees to keep the dog in good physical condition with regularly scheduled health visits with their veterinarian for the proper ongoing health appropriate for your area, as recommended by the veterinarian. The Buyer further agrees to provide proper shelter, exercise, fresh water, high-quality dog food, treats, pet care products, and nutritional supplements appropriate for your dog. ABUSE/NEGLECT: If the dog is mistreated, neglected, abused in any way, kept outside in extreme heat or extreme cold conditions, kept on wire flooring, the Breeder has the right to reclaim the dog immediately, with no notice or compensation to the Buyer and the Buyer shall voluntarily surrender the dog to the
Breeder along with any kennel club registration, microchip records, and health records.
REHOME OR RETURN OF DOG: If the Buyer needs to rehome the dog, the Buyer agrees to rehome the dog to a good, suitable home. If the Buyer is unable to rehome the dog accordingly, Buyer agrees to return the dog to the Breeder. The Breeder doesn't wish for any dog to be sold, given to any pet shop, animal shelter, rescue, research laboratory, or other similar facility. All costs associated with the dog return shall be borne by the Buyer and the dog's ownership along immunization, and medical records, etc. shall be transferred to the Breeder simultaneously.
Our puppies are not sold on a "trial basis". If FOR ANY REASON DURING THE FIRST YEAR the puppy does not work out at your home, the Purchaser will return
the puppy with the contract, health guarantee, and all other necessary documents. The Purchaser will receive NO refund of money, NO replacement puppy, and NO veterinarian bills will be reimbursed. The Purchaser will be responsible for all shipping costs associated with returning the puppy. MISCELLANEOUS: Should legal action become necessary by the Buyer to enforce the Buyer's obligations herein, the Buyer shall be responsible for all costs and fees including, but not limited to court costs, attorney fees, office and mailing fees, travel fees, etc.
THIS AGREEMENT IS A LEGALLY BINDING. ANY COURT COSTS AND ATTORNEY FEES NECESSARY TO ENFORCE THIS AGREEMENT SHALL BE BOURNE BY BUYER IN THE STATE OF WASHINGTON AND THE LAWS OF THE STATE OF WASHINGTON, SPOKANE, UNITED STATES OF AMERICA WILL GOVERN THE INTERPRETATION OF THIS AGREEMENT.
THIS AGREEMENT APPLIES SOLELY TO THE BUYER AND IS NOT TRANSFERABLE. THERE ARE NO OTHER GUARANTIES, EXPRESSED OR
IMPLIED, EXCEPT AS CONTAINED HEREIN.
